If it's war, how's it a conspiracy?

A former spokesman for al-Qaeda and son-in-law of Osama bin Laden pleaded not guilty Friday to a charge that he conspired to kill Americans.

But if he's the enemy in the war on terror that the U.S. has waged since 9/11, is is it correct to call opposing forces as conspiring to kill Americans?

Is it a crime to attempt to repel or defeat the aggressor?
